2.1."We "or " the Company "or any other expression refers to Sojournplanet LLC.
2.2."You "or " the client "or any other expression referring to the service taker refers to the person using our services .
2.3. "Services" refers to the travel creation and booking services, as well as all kinds of complementary services offered by Sojournplanet LLC
2.4. "Contract" means the legally binding agreement between you and us, established once you make payment for the service or booking deposit and expressly declare your agreement through the means provided for this purpose by us.
2.5. "Supplier" refers to third parties providing transportation, accommodation, and other services related to your travel.
3.1 A legally binding contract between you and us is established only when we send you our booking confirmation after receiving your payment in released funds of the necessary deposit, the total price of your holiday or payment of the requested service, as applicable.
3.2. By making a booking, you confirm that you have the authority to accept these terms and conditions on behalf of all members of your travel party.
3.3 The contract between you and us will be governed by these terms and conditions, as well as any additional information provided during the booking process.
3.4. Sojournplanet can as well design your ideal trip or book Travel services on your behalf. Specific conditions will be shared with you before completing payment.
4.1 While we strive to ensure that the information on our website is accurate and not misleading, please be aware that it may have been published many months before your travel experience and could be subject to change.
4.2 We reserve the right to make changes to our website and any information it contains at any time. All details of your experience will be confirmed in your booking confirmation. For any changes that we might make after issuing your booking confirmation, please refer to Section 7.
5.1. We reserve the right to adjust trip prices on our website or in written proposals before booking confirmation. The current price will be communicated before confirmation. Prices are quoted in USD and based on the exchange rates at the time of the quote.
5.2. The price of your experience includes taxes and any applicable fees, charges, and other costs. If there are additional costs that cannot be calculated in advance, we will inform you of the potential types of costs at the time of booking.
5.3. All payments made with debit or credit cards will be processed in USD. If your card is in another currency, the final price will be based on the exchange rate on the day your card issuer processes the transaction.
5.4. Payments must be made in the currency specified on the invoice, with the payer responsible for any bank charges. Payments can be made via cheque, bank transfer, or debit/credit card. Bookings are confirmed only after receiving cleared funds. All card payments are encrypted with SSL for security.
5.5. The final payment must be made before departure as per the terms of each travel supplier. Failure to pay by the due date may result in cancellation and forfeiture of deposits.
6.1. Any request to cancel or amend your booking must be sent in writing to our postal address or via email to contact@sojournplanet.com.
6.2. An administrative fee of $75 will apply for changes to the booking, in addition to any additional costs incurred.
6.3. Cancellations may result in charges that vary depending on the notice given and specific conditions from the vendor. Cancellation charges can be up to 100% of the total trip price.
6.4. If you wish to change your booking, we will do our best to assist you, but we cannot guarantee that all changes will be possible. Changes are subject to availability and the policies of the service providers.
6.5. If we are unable to make the requested changes and you decide to cancel, the relevant cancellation fees will apply.
6.6. Please review the coverage of the travel insurance included with your booking and consider obtaining additional coverage if necessary to protect your investment against unforeseen circumstances.
7.1. If we are forced to make significant changes, we will notify you as soon as possible and give you the option to accept the changes or cancel the contract without cancellation charges.
7.2. If we cancel your trip, we will offer alternative arrangements of comparable or better quality. If no alternatives are available, you will receive a full refund of the trip price.
7.3. We will not be responsible for any additional expenses incurred by you as a result of changes or cancellations, except as specifically stated in these terms and conditions.
8.1. All our reservations include travel insurance to ensure adequate protection. Please review the details of included coverage to understand what is provided.
8.2. The company acts solely as an intermediary for independent suppliers providing transportation, accommodations, sightseeing, activities, and other services. These services are subject to the terms and conditions of the suppliers. Sojournplanet LLC accepts no liability for any injury, damage, loss, accident, delay, or incident caused by the negligence, defect, or default of any supplier.
8.3. Sojournplanet LLC is not responsible for any accidents, losses, or damages incurred by the Client during their travel. The agency acts only as an agent for service providers and does not assume any responsibility for the services provided by these providers.
8.4. Although Sojournplanet LLC cannot be held responsible for any accidents, loss, or damage during the trip, it will always act in your favor using all channels at its disposal and providing 24-hour assistance to facilitate resolution.
8.5. Sojournplanet LLC does not accept responsibility for losses, injury, damages, or expenses due to sickness, weather, strikes, hostilities, wars, terrorist acts, acts of nature, local laws, or other causes beyond its control.
8.6. All services and accommodations are subject to the laws and regulations of the country in which they are provided. Sojournplanet LLC is not responsible for any baggage or personal effects of any individual participating in the tours/trips arranged by the agency.
8.7. Once Sojournplanet LLC has designed a trip and the customer accepts the bid, the customer acknowledges that though Sojournplanet LLC agrees to make all reasonable efforts to ensure the trip is consistent with the bid,Sojournplanet LLC cannot be held responsible for actions of vendors or unforeseen events that affect the customers satisfaction.
9.1. We will provide U.S. citizens with general information on passport, visa, and health requirements for your trip destinations, including estimated time frames for obtaining visas.
9.2. The TSA and DHS recommend that passengers carry at least two valid forms of identification to board a flight, such as a DHS-designated enhanced driver's license, a U.S. passport, or a foreign government passport. 9.3. Most countries require passports to be valid for at least six months beyond your return date. You are responsible for ensuring your passport meets this requirement.
9.4. You are responsible for obtaining all necessary travel documents and visas in advance, and ensuring compliance with health requirements for your destination. We are not liable if you or any member of your party is denied entry due to incorrect documentation or failure to meet health formalities. 9.5. If you or any member of your party has a disability, reduced mobility, or pre-existing medical condition, inform us before booking to ensure the travel experience is suitable and safe. This allows us to make necessary arrangements. Health and mobility information will be used only to advise on your booking and communicate with travel suppliers, in accordance with our Privacy Policy.
9.6. You are responsible for meeting all health requirements for your destination, including vaccinations and other medical precautions. A health requirements, vaccinations and other medical precautions management service is available for a fee as outlined in Our Services.
10.1. Traveling to certain destinations can present higher risks compared to others. Sojournplanet advises customers to stay updated with daily news and to review travel restrictions, alerts, and advisories issued by the U.S. government before booking international trips.

10.3. The Smart Traveler Enrollment Program (STEP) is a complimentary service provided by the U.S. government for U.S. citizens traveling or residing abroad. STEP allows you to input information about your upcoming trip so the State Department can assist you more effectively in emergencies. 10.4. By providing travel options to specific destinations, Sojournplanet does not guarantee that travel to these locations is advisable or risk-free. Customers acknowledge and accept that participating in such travel is done at their own risk. We shall not be held responsible for any expenses, damages, or losses that may occur as a result of traveling to these places.
10.5. We will provide updated information on travel risks and conditions whenever possible, but it is your responsibility to be aware of current travel advisories and recommendations through reliable sources such as the U.S. Department of State website.
11.1. Regardless of our liability for compensation, we are committed to providing you with prompt and appropriate assistance should you encounter difficulties during your trip.
11.2. This support includes offering relevant information about health services, local authorities, and consular assistance. We will also help you make distance communications and find alternative travel arrangements if necessary.
11.3. However, should the difficulty arise due to actions taken intentionally by you or through your negligence, we may charge you a reasonable fee for this assistance.
11.4. This approach ensures that we can offer help when it's needed, while also encouraging responsible behavior from our travelers.
12.1. While we will make every effort to accommodate any special requests you may have—such as specific airline seating, dietary requirements, or particular room preferences—and will pass these requests on to the relevant suppliers, we cannot guarantee that all requests will be fulfilled. Please understand that these special requests are subject to availability and the policies of the respective service providers.
12.2. Consequently, we are not liable for any loss or inconvenience that may arise if these requests are not met. We appreciate your understanding and will do our best to ensure your needs are communicated clearly to those providing your travel services.
13.1. When excursions and/or activities are booked and paid for in advance as part of your trip price and detailed in our booking confirmation, they are considered part of your package contract with us.
13.2. We commit to using reasonable skill and care in selecting suppliers to provide these excursions and activities, ensuring they meet our standards and contribute positively to your travel experience.
13.3. Excursions or activities purchased directly from local suppliers or third parties after your trip begins are not part of your contract with us. These arrangements are solely between you and the supplier, governed by their terms. We are not liable for the performance, quality, or safety of these independently arranged activities. Exercise caution and consider the provider's reputation when booking additional services.
14.1. To process your booking, we need to collect personal information, including your name, address, email, phone number, and details of your travel companions. We also require information about any special needs, health, medical, mobility, or dietary requirements.
14.2. Sojournplanet LLC is the data controller for the personal information you provide. We handle your data in accordance with U.S. data protection laws, ensuring it is processed securely and lawfully. This commitment protects your privacy while allowing us to deliver the services you requested.
14.3. To tailor your holiday to your specific needs, including any medical conditions or reduced mobility, we or our suppliers may need additional details. We will ask for your explicit consent to collect and share this information with the necessary suppliers to fulfill your booking.
14.4. The personal information you provide, including health and mobility data, may be shared with relevant suppliers like airlines, hotels, transport companies, local tour operators, and destination management companies to properly fulfill your contract.
14.5. To process and fulfill your contract, your personal information may be shared with public authorities, including customs, immigration, security, credit checking companies, and credit/debit card companies. It may also be required by government and enforcement agencies to fulfill your booking or as mandated by law, including sharing data with police or other law enforcement agencies for security purposes.

15.1. This contract is governed by the laws of the state of Michigan, and any disputes will be resolved in the appropriate courts in Michigan.
15.2. By accepting these terms and conditions, you agree to submit to the exclusive jurisdiction of the courts in Michigan.
15.3. If any provision of these terms and conditions is found to be invalid or unenforceable, the remaining provisions will remain valid and enforceable.

17.2. If your complaint isn't resolved on the spot, please contact us directly so we can try to rectify the situation and make any necessary alternative arrangements.
17.3. Should the issue remain unresolved by the end of your trip, you are encouraged to formally report this to our Customer Services Department. Please send a written complaint within 28 days of your return, detailing the issues encountered, to:
